Constitutional Court Rejects 2024 Presidential Election Dispute Lawsuit by Anies-Cak Imin

JAKARTA - The Constitutional Court (MK) has rejected the dispute lawsuit over the 2024 Presidential Election filed by the presidential and vice-presidential candidate pair number 1, Anies Baswedan-Muhaimin Iskandar, on Monday (22/4/2024).


This means that the decision of the General Election Commission (KPU) regarding the results of the 2024 Presidential Election, where presidential and vice-presidential candidate pair number 2, Prabowo Subianto-Gibran Rakabuming Raka, remains valid.

The decision of the Constitutional Court was delivered by Chief Justice Suhartoyo in a hearing held since 09.00 WIB.

"The petitioner's request is rejected in its entirety," said Suhartoyo.

In their lawsuit, Anies-Cak Imin requested the Constitutional Court to annul the results of the 2024 Presidential Election.

One of the arguments they presented was related to Gibran's status as vice president not in accordance with KPU Regulation Number 19 of 2023.

However, the Constitutional Court rejected this argument.

The reason, through Judge Enny Nurbaningsih, the Constitutional Court conveyed that the reports regarding the matter had been followed up with handling of violations and discussions by the Election Supervisory Agency (Bawaslu).

"Thus, according to the Court, Bawaslu and its staff have followed up on the reports submitted by the Petitioner," she said.

Enny continued, they assessed that the handling of cases in Bawaslu was still formalistic.

For that reason, Enny provided input to Bawaslu to make improvements.

"It is necessary to make fundamental changes in the regulation regarding election supervision, including the procedures for enforcement if violations occur at each stage of the election so that, Bawaslu must enter into the substance of reports or findings to substantiate whether or not there has been a substantial violation of the elections, including in this case the election of regional heads," said Enny.

"Meaning, if the intended changes are not made, it will threaten the realization of honest, fair, and integrity elections," Enny added.

Alleged Jokowi Intervention Not Proven

Furthermore, in the hearing, it was explained that there was no convincing evidence regarding the accusation that President Joko Widodo (Jokowi) intervened in the nomination of Gibran Rakabuming Raka as vice president.

Constitutional Judge Arief Hidayat conveyed that the arguments by the Anies-Muhaimin camp claiming nepotism in Decision Number 90/PUU-XXI/2023 regarding the age limit of Presidential Election participants were not convincing.

"Regarding the petitioner's arguments a quo about the decision of the Constitutional Court Number 2 of 2023 which stated the existence of serious ethical violations in the decision-making of the Constitutional Court Number 90, it does not immediately become sufficient evidence to convince the court that nepotism has occurred," said Arief.

Therefore, Arief considered it inappropriate for the Anies-Muhaimin camp to challenge Gibran's nomination based on Decision Number 90/PUU-XXI/2023.

"Thus, according to the Court, the issue of compliance with the requirements for Gibran Rakabuming Raka as a vice-presidential candidate from the relevant party and the results of the verification and determination of candidate pairs carried out by the respondent," Arief emphasized.

Additionally, Arief mentioned that the panel of judges did not find strong evidence of President Joko Widodo's intervention in the Constitutional Court's decision paving the way for Gibran as vice president.

"And there is no convincing evidence that the Court has intervened in the change in the requirements for the 2024 presidential candidate pairs," said Arief.
